These Terms & Conditions govern the use of the website kinko.pro and the purchase of subscriptions to the Kinko service from RSG SOFTSYNC LIMITED.

By accessing our website, creating an account or placing an order, you agree to these Terms & Conditions.

2. Scope of Services

Kinko is a cloud-based workflow-management service (software as a service). We sell paid subscriptions that give you access to the service for a chosen plan and billing period.

A subscription may include, depending on the plan:

  • access to the Kinko workspace for the number of members allowed by the plan;
  • task, project and workflow management features;
  • reporting, dashboards and automation features;
  • file storage within the plan’s limits;
  • customer support at the level stated for the plan.

Subscriptions are offered on a monthly or annual basis. The features, limits and prices of each plan are described on the Pricing page.

3. User Account

To access certain features of the website, you may be required to create a user account.

You agree to:

  • provide accurate and complete information;
  • keep your login details confidential;
  • update your account information when necessary;
  • notify us if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that are used fraudulently, unlawfully or in breach of these Terms.

4. Service Information

We make reasonable efforts to ensure that plan descriptions, feature lists, screenshots, prices and availability shown on the website are accurate.

However, minor differences may occur, including:

  • screenshots and illustrations that reflect an earlier version of the interface;
  • features that are gradually rolled out, improved or replaced with equivalent functionality;
  • changes to plan limits that apply to new purchases only.

If a significant error is identified after you place an order, we may contact you to confirm whether you wish to proceed, modify or cancel the order.

5. Prices

All prices are displayed in Euro.

Prices may include or exclude VAT depending on the customer type, your country and applicable tax rules. The final price, including applicable taxes, will be shown before checkout. There are no delivery charges — Kinko is a digital service.

We reserve the right to change prices at any time. Price changes do not affect subscription periods that have already been paid for.

6. Orders

An order is placed when you complete the checkout process and submit payment or payment instructions.

After placing an order, you may receive an order confirmation by email. This confirmation does not automatically mean that the order has been accepted if there is an error, payment issue or suspected fraud.

We reserve the right to refuse or cancel an order where:

  • the plan is no longer offered;
  • payment is not completed;
  • incorrect information was provided;
  • the price or plan information was clearly incorrect;
  • fraud or misuse is suspected;
  • legal restrictions prevent the sale.

7. Payment

We may accept the following payment methods:

  • bank transfer;
  • payment card;
  • online payment services;
  • other payment methods shown at checkout.

Payment processing may be handled by third-party payment providers. We are not responsible for delays or issues caused by payment providers, banks or card issuers.

Subscriptions are paid in advance for the billing period selected at checkout (monthly or annual). Access to the service is activated only after full payment has been received.

8. Access to the Service

We offer the service to customers in the European Union (Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden) and the United Kingdom.

Kinko is delivered digitally — no physical shipping is involved:

  • access to your subscription is activated immediately after successful payment;
  • your account details and the receipt are sent to the email address provided at checkout;
  • the service is accessed through a web browser at kinko.pro;
  • your subscription runs for the billing period selected at purchase.

We aim to keep the service available at all times, but short interruptions may occur for maintenance, updates or reasons outside our reasonable control.

9. Right of Withdrawal for Consumers

If you are a consumer located in the European Union or the United Kingdom, you generally have the right to cancel (withdraw from) a distance purchase within 14 days without giving any reason. This right arises under the EU Consumer Rights Directive (2011/83/EU) and, in the United Kingdom, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

For services, the withdrawal period expires 14 days after the day the contract is concluded (the day of purchase). Because access to Kinko begins immediately after payment at your request, if you withdraw within the 14-day period you may be required to pay a proportionate amount for the part of the subscription period already elapsed, and the remainder will be refunded.

To exercise the right of withdrawal, you must inform us by email or written notice before the withdrawal period expires.

10. Cancellation of a Subscription

There is nothing to return for a digital service. If you withdraw from the contract, or if a subscription ends and is not extended:

  • access to the paid features of your workspace is deactivated;
  • your data remains available for export for a reasonable period, after which it may be deleted in line with our Privacy Policy;
  • any refund due is processed as described below.

11. Refunds

If the withdrawal is valid, we will refund the payments received from you, less a proportionate amount for the part of the subscription period during which the service was available to you, where permitted by law.

Refunds will usually be made using the same payment method used for the original transaction, unless otherwise agreed, within 14 days of accepting the withdrawal.

12. Exceptions to the Right of Withdrawal

The right of withdrawal may not apply, or may be limited, in certain cases, including:

  • where a service has been fully performed within the withdrawal period with your prior express consent and acknowledgement that the right of withdrawal is lost once the contract has been fully performed;
  • where digital content is supplied immediately with your prior express consent and acknowledgement that the right of withdrawal is thereby lost;
  • plans or services personalized to your specific requirements (for example, custom Enterprise arrangements), to the extent permitted by law.

13. Service Quality and Legal Guarantees

Consumers in the European Union and the United Kingdom have legal rights if a digital service does not conform to the contract — for example, if it is not as described or persistently does not work as expected. Under the EU Digital Content and Digital Services Directive (2019/770) and, in the United Kingdom, the Consumer Rights Act 2015, you may be entitled to have the service brought into conformity, to a proportionate price reduction, or to a refund, depending on the situation.

If something in Kinko does not work as it should, please contact us at info@kinko.pro and provide:

  • the email address your account is registered to;
  • order number, if the issue concerns billing;
  • a description of the issue and, if possible, the steps to reproduce it;
  • screenshots, if relevant.

We aim to respond to support requests within one business day.

14. Business Customers

If you purchase a subscription as a business customer, certain consumer protection rights (including the right of withdrawal) may not apply.

Business customers are responsible for ensuring that the service is suitable for their intended business use before placing an order.

Additional terms may apply to B2B and Enterprise arrangements, including payment terms, VAT treatment, service levels and data-processing agreements.

15. Acceptable Use of the Website

You agree not to use the website:

  • for unlawful purposes;
  • to upload malicious code;
  • to attempt unauthorized access;
  • to interfere with website security;
  • to copy or scrape website content without permission;
  • to provide false or misleading information;
  • to abuse promotions, accounts or checkout systems.

We may restrict, suspend or terminate access to the website if these rules are breached.

16. Intellectual Property

All content on the website, including text, product descriptions, images, logos, design, layout and software, belongs to us or our licensors unless otherwise stated.

You may not copy, reproduce, distribute, modify or commercially exploit website content without prior written permission.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • indirect or consequential losses;
  • loss of profit;
  • loss of data;
  • website downtime;
  • third-party service failures;
  • delays caused by payment providers, banks or force majeure events.

Nothing in these Terms limits liability where such limitation is not permitted by law, including liability for fraud, intentional misconduct or consumer rights that cannot be excluded.

18. Force Majeure

We are not responsible for failure or delay caused by events outside our reasonable control, including:

  • natural disasters;
  • war or civil unrest;
  • strikes;
  • technical failures;
  • power outages;
  • failures of hosting or infrastructure providers;
  • government restrictions;
  • cyberattacks.

19. Privacy

We process personal data in accordance with our Privacy Policy and Cookie Policy, which form part of these Terms.

20. Changes to These Terms

We may update these Terms & Conditions from time to time. The updated version will be published on this page with the revised “Last updated” date.

The version of the Terms in force at the time of your order will apply to that order.

21. Governing Law and Disputes

These Terms are governed by the laws of United Kingdom, unless mandatory consumer protection laws provide otherwise.

If you are a consumer in the European Union or the United Kingdom, you may also have rights under the mandatory consumer protection laws of your country of residence, which are not affected by these Terms.

Disputes may be submitted to the competent courts of London, United Kingdom, unless mandatory law provides another jurisdiction.
